PRIVACY POLICY

As we support you in your sporting projects, Nolio is also committed to an approach respectful of your privacy.

This is why we inform you of the processing carried out with regard to your own data.

In accordance with French Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties (hereinafter the « Loi Informatique et Libertés », the French Data Protection Act), and with European Regulation 2016/679 of 26 April 2016, we take care to protect your personal data.

Nolio, your data controller, the guarantor of your data

In order to provide you with a functional application that best meets your expectations, certain data is processed, and this for a plurality of purposes:

  • In order for you to access the various services offered by the application, the creation of an account becomes necessary. How else could you track your own progression? This is why we ask you to provide your last name, first name, email and favorite sport. This information is retained only during the period of use of the account. If you decide to close it, this data likewise leaves us.

  • We also offer the provision of paid services, whether as part of your subscription, our marketplace, a referral or a connection with the programs offered by coaches. Accordingly, certain information is necessary for us to keep our accounts. This includes, in particular, payment statuses. This time, we retain it for a longer period, namely 10 years. So that your payment proceeds without a hitch, we have decided to work with the company STRIPE, which acts as a joint controller. For more information on this subject, we invite you to consult their data protection policy.

  • Users may also invite partners to use the application and to join their team. To do so, the partner's email address is entered into Nolio so that they can receive the invitation. These email addresses are not used for any other purpose. Where no response is provided by the invitee, this data is retained only for a limited period, namely 6 months.

  • We are committed to Nolio being an application in constant evolution; in order to offer you new features ever closer to your expectations, we process some of your data statistically while preserving your anonymity.

Your data is not currently sold to third parties. Should this ever be the case one day, we undertake to seek your express consent by any means of communication and to inform you of the context of the sale, while allowing a reasonable period for you to exercise your choice.

Through our website and to keep you informed of our activity, you can subscribe to a newsletter.

Only your email address is collected and we retain it throughout the entire period of your subscription.

  • Nolio, a trusted data processor

The Nolio application provides you with an environment enabling the monitoring of your sporting activity or that of the athlete you support.

The types of data you wish to enter into the application are entirely at your discretion. These may be organizational data, performance data but also health data. The latter are

considered sensitive data requiring particular attention on your part, even more so when data is shared with your coach, with the athlete you support, or from the applications you connect to Nolio.

It is therefore your own responsibility to have control over your personal data and to be aware of the processing carried out depending on the relationships you maintain with your partners:

You are an athlete, with no relationship to a team or a coach:

  • You are in sole control, and you alone have the ability to enter, access, modify and delete your own data. To prevent illegitimate access to your data, it is your responsibility to maintain the confidentiality of your credentials and passwords.

You are an athlete and in a relationship with a coach:

  • You share the ability to enter, access and modify your data with your coach, but you alone retain the ability to delete it.

  • Should you no longer wish your coach to enter, access, or modify your data, you simply need to leave the relevant team.

  • To prevent illegitimate access to your data, it is your responsibility to maintain the confidentiality of your credentials and passwords.

  • The application also provides free-text fields. A certain amount of caution must be adopted with regard to them in order to enter data in accordance with the Terms of Use. This means respecting the very functioning of the application and not using it for improper purposes or for objectives not envisaged at the time of its design.

You are a coach and in a relationship with an athlete:

  • You share the ability to enter, access and modify the athlete's personal data. You thus have the ability to carry out data processing for which you are responsible. It is only natural that this data must be processed in a fair, transparent manner and exclusively for the purpose established with the athlete.

  • To prevent illegitimate access to your data, it is your responsibility to maintain the confidentiality of your credentials and passwords.

  • The application also provides free-text fields. A certain amount of caution must be adopted with regard to them in order to enter data in accordance with the Terms of Use. This means respecting the very functioning of the application and not using it for improper purposes or for objectives not envisaged at the time of its design.

So that you have access to your data, continuously and throughout the entire active period of your account, we store it for you with a specialized host (Cf. Where is your data stored?).

  • Where is your data stored?

So that your data is secured by true professionals, all of this data is hosted on servers administered by AWS, located in Paris, France. The AWS servers are “HDS”-certified -> https://aws.amazon.com/compliance/hds/

So that your training workout data and your media files are even more secure, we have chosen to back up your data within the same Amazon (AWS) infrastructure.   • Does your data cross the borders of the European Union?

As the General Data Protection Regulation applies to all member countries of the European Union, your data benefits from its protection throughout this entire territory.

Accordingly, we ensure that Nolio and its data processors do not carry out any transfer of data outside the European Union.

However, when operations require processing to be outsourced beyond these limits, the transfers or processing carried out outside the EU are covered:

  • By your express consent

  • By a derogation falling under Article 49 of the GDPR

  • By appropriate safeguards such as standard contractual clauses approved by the European Commission. Where applicable, you may obtain a copy of these safeguards by contacting our DPO.

  • As an individual, you also have a multitude of rights.

As an athlete, a user of the application, a natural person protected by the GDPR, you can keep control of your personal data. How? By exercising, if necessary, the rights available to you. You can thus contact us at this address: contact@nolio.io

The right of access: as a user of the application, you are entitled to ask us to view your personal data that we process.

The right to rectification: when you find that your data is no longer up to date and needs to be updated you can modify it directly via the application.

The right to erasure ("right to be forgotten"): if you no longer wish Nolio to process your data, closing the account allows the data you have entered to be deleted.

The right to data portability: should you wish to transfer the data entered into the application, contact us and we will provide them to you in an open and interoperable format (e.g. CSV).

The right to restriction of processing: you no longer want your data to be subject to processing or modification? In addition to exercising another right, you can ask us so that we can respond as soon as possible.

Right to object: to stop receiving information emails from Nolio, let us know by contacting us directly at the address indicated previously.

If you are not satisfied with the response we have provided and you consider that your rights have not been respected, you may lodge a complaint with the CNIL (the French supervisory authority) at the following address: https://www.cnil.fr/en/plaintes.
